Welcome to EZ Horoscope. These Terms of Service (“Terms”) govern your access to and use of the EZ Horoscope website, WordPress plugin, Shopify application, APIs, and related services (collectively, the “Services”) provided by Shadowhill Enterprises, LLC (“we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Description of Services

EZ Horoscope provides astrological content and tools, including:

Website (ezhoroscope.com): Horoscopes, astrology information, and educational content
WordPress Plugin: Embeddable horoscope content for WordPress websites
Shopify App: Astrological content integration with product placement for Shopify storefronts
API: Programmatic access to horoscope and astrology data
Voice AI Agents: Conversational astrological guidance powered by artificial intelligence

Our Services generate content using astronomical calculations (Swiss Ephemeris) and artificial intelligence (OpenAI). All astrological content is provided for entertainment and informational purposes only.

2. Acceptance of Terms

By using our Services, you represent that:

You are at least 16 years of age
You have the legal capacity to enter into these Terms
If using the Services on behalf of an organization, you have authority to bind that organization to these Terms
You will comply with all applicable laws and regulations

3. Account Registration

Some features of our Services require account registration. When you create an account, you agree to:

Provide accurate, current, and complete information
Maintain the security of your account credentials
Promptly update your information if it changes
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. WordPress Plugin

License Grant

We grant you a limited, non-exclusive, non-transferable license to install and use the EZ Horoscope WordPress plugin on websites you own or control, subject to these Terms.

Free and Premium Features

The free version includes basic horoscope content functionality
Premium features require a valid license purchase
License keys are for use on the number of sites specified at purchase
Sharing or redistributing license keys is prohibited

Plugin Updates

We may release updates to improve functionality, fix bugs, or address security issues. You are responsible for keeping the plugin updated. We are not liable for issues arising from outdated versions.

WordPress.org Guidelines

Use of the plugin hosted on WordPress.org is also subject to the WordPress.org guidelines and terms.

5. Shopify Application

Installation and Authorization

By installing the EZ Horoscope Shopify app, you authorize us to:

Access your store information necessary to provide the Services
Display content on your storefront via theme app extensions
Process billing through Shopify’s payment system

Shopify Platform

The Shopify app operates within Shopify’s platform. Your use is also subject to Shopify’s Terms of Service. We are not responsible for Shopify’s platform availability, policies, or changes.

Subscription and Billing

The app offers a free tier with basic horoscope content
Product placement features require a paid subscription
Subscription pricing is based on your Shopify plan tier
All billing is processed through Shopify; we do not collect payment information directly
Subscriptions renew automatically until cancelled
You may cancel your subscription at any time through the app’s billing page
Refunds are subject to Shopify’s refund policies

Uninstallation

You may uninstall the app at any time through your Shopify admin. Upon uninstallation:

Your access to the Services will terminate immediately
We retain your configuration data for 30 days in case you reinstall
After 30 days, your data is permanently deleted
You may request immediate deletion by contacting support@ezhoroscope.com

6. API Usage

API Access

Access to our API requires valid credentials. API usage is subject to:

Rate limits as specified in our API documentation
Fair use policies
Our current API terms and pricing

Restrictions

You may not:

Exceed rate limits or circumvent usage restrictions
Resell API access without written authorization
Use the API to build a competing service
Scrape or bulk download content beyond API allowances

API Changes

We may modify, deprecate, or discontinue API features with reasonable notice. We recommend subscribing to our developer communications for updates.

7. Content and Intellectual Property

Our Content

All content, software, designs, logos, and materials provided through our Services are owned by Shadowhill Enterprises, LLC or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Generated Content

Horoscope content generated for your use through our Services may be displayed on your website or storefront as intended by the Services. You may not:

Claim authorship of AI-generated content
Remove or alter attribution where required
Resell generated content as a standalone product

Your Content

You retain ownership of content you provide (such as product information for placement). By providing content, you grant us a license to use it as necessary to provide the Services.

8. Astrological Content Disclaimer

IMPORTANT: All astrological content provided through our Services is for entertainment and informational purposes only. We make no claims regarding the accuracy, reliability, or applicability of astrological interpretations.

Our Services do not provide:

Medical, health, or psychological advice
Financial or investment advice
Legal advice
Professional guidance of any kind

You should not make important life decisions based solely on astrological content. Always consult qualified professionals for matters requiring expertise.

9. Third-Party Services

Our Services integrate with third-party providers, including:

OpenAI: For AI-generated content
Swiss Ephemeris: For astronomical calculations
Shopify: For e-commerce platform integration
WordPress: For content management integration
Stripe: For payment processing (where applicable)

We are not responsible for third-party services’ availability, accuracy, or terms. Your use of third-party services is subject to their respective terms and policies.

10. Acceptable Use

You agree not to use our Services to:

Violate any laws or regulations
Infringe on intellectual property rights
Transmit malware or malicious code
Interfere with or disrupt the Services
Attempt to gain unauthorized access to our systems
Harass, abuse, or harm others
Generate or distribute misleading or fraudulent content
Violate platform policies (Shopify, WordPress, etc.)

We reserve the right to suspend or terminate access for violations.

11. Privacy

Your use of our Services is also governed by our Privacy Policy, available at https://ezhoroscope.com/privacy-policy/. By using our Services, you consent to our collection and use of information as described in the Privacy Policy.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF CONTENT
UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that the Services will meet your requirements or that any errors will be corrected.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHADOWHILL ENTERPRISES, LLC SHALL NOT BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES
DAMAGES ARISING FROM THIRD-PARTY SERVICES OR CONTENT

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Shadowhill Enterprises, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

Your use of the Services
Your violation of these Terms
Your violation of any third-party rights
Content you provide through the Services

15. Termination

By You

You may stop using our Services at any time. For the Shopify app, uninstall through your Shopify admin. For the WordPress plugin, deactivate and delete the plugin. For API access, discontinue use of your credentials.

By Us

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Reasons for termination may include:

Violation of these Terms
Fraudulent or illegal activity
Non-payment (for paid services)
Extended periods of inactivity
Discontinuation of the Services

Effect of Termination

Upon termination:

Your right to use the Services ceases immediately
Provisions that by their nature should survive will survive (including disclaimers, limitations of liability, and indemnification)

16. Modifications to Terms

We may update these Terms from time to time. When we make changes:

We will update the “Last Updated” date
For material changes, we may notify you via email or through the Services
Continued use after changes constitutes acceptance

We encourage you to review these Terms periodically.

17. Modifications to Services

We reserve the right to:

Modify, update, or discontinue any part of the Services
Change pricing with reasonable notice
Add or remove features

We will endeavor to provide notice of significant changes, but are not obligated to maintain any particular feature.

18. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Orange County, California.

19. Dispute Resolution

Informal Resolution

Before filing a formal dispute, you agree to contact us at support@ezhoroscope.com to attempt to resolve the matter informally. We will attempt to resolve disputes within 30 days.

Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or your use of the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Orange County, California, unless you and we agree otherwise.

Class Action Waiver

YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Services.

20. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shadowhill Enterprises, LLC regarding the Services.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.
